These Terms and Conditions ("Terms") govern your access to and use of auto-xpert.org (the "Site") operated by Auto Xpert ("Auto Xpert", "we", "us" or "our"), and your submission of quote requests through the Site. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Auto Xpert is an automotive protection and customization business located at 1290 Old County Rd B, Belmont, CA 94002, providing services including window tinting, paint protection film, vinyl wraps, ceramic coating, paint correction, and related commercial services.
You may use the Site only for lawful purposes. You agree not to:
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have breached these Terms.
Pricing shown on the Site, including promotional pricing, is provided for general information only and is an estimate, not a binding offer. Prices depend on vehicle make, model, size, paint condition, coverage level, and the materials selected.
A quote request submitted through the Site is a request for information and does not create a contract. A binding agreement is formed only when we confirm the work, the price, and the schedule with you directly, in writing or in person.
We reserve the right to correct pricing errors, to decline any request, and to change or withdraw promotions at any time. Promotional offers are subject to the specific conditions stated alongside them, cannot be combined unless expressly stated, and are limited to the period advertised.
Our services are applied to the vehicle in the condition in which it is presented. You acknowledge that:
You are responsible for removing personal belongings from the vehicle before service. We are not responsible for items left in a vehicle.
Window tinting is regulated by the California Vehicle Code, which sets limits on visible light transmission and on which windows may be tinted. Auto Xpert will not apply window film that does not comply with California law. If you request a film or configuration that would be unlawful, we will decline the work and will explain the compliant options available to you.
We will advise you on the legal limits that apply to your vehicle. Where you intend to drive the vehicle regularly outside California, please tell us before work begins, as other states set different limits and a film that is lawful in California may not be lawful elsewhere. We are not responsible for compliance with the law of jurisdictions outside California, or for changes in the law after the work is completed.
Where a medical exemption is claimed, you are responsible for obtaining and retaining the documentation required by the State of California, and for producing it on request.
Manufacturer warranties on films, wraps and coatings are provided by the manufacturer of the product, on the terms and for the period stated by that manufacturer. We will pass through the benefit of such warranties where applicable.
We warrant our installation workmanship for the period communicated to you at the time of service. This warranty covers defects in installation such as lifting, bubbling or peeling arising from workmanship, and does not cover damage caused by accident, abuse, improper care, automatic car washes, abrasive chemicals, road debris impact, third-party work, or normal wear.
Except as expressly set out in these Terms or provided by the product manufacturer, and to the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.
Appointments are scheduled in advance. Where a deposit is required, it will be communicated to you at the time of booking. We ask that you give reasonable notice if you need to cancel or reschedule. Deposits may be non-refundable where materials have been ordered or cut specifically for your vehicle.
Vehicles left beyond the agreed collection date may be subject to storage charges.
The Site contains material owned by Auto Xpert and material licensed from third parties. Text, the Auto Xpert name and logo, and photographs and video of work carried out at our shop are owned by Auto Xpert and are protected by copyright, trademark and other intellectual property laws.
Some images on the Site are stock photographs licensed from third-party providers. Those images remain the property of their respective owners and are used by us under licence; no ownership of them is claimed by Auto Xpert, and nothing on the Site grants you any right to use them.
You may view and print pages for your own personal, non-commercial use. You may not otherwise reproduce, distribute, modify, publish or create derivative works from any part of the Site without our prior written consent and, where applicable, the consent of the relevant rights holder.
Vehicle makes, models and marks shown on the Site belong to their respective owners and are used for identification purposes only; their appearance does not imply any affiliation with or endorsement by those owners.
The Site may contain links to third-party websites and may display content supplied by third parties. We do not control and are not responsible for the content, accuracy, or practices of any third-party site.
The Site and its content are provided "as is" and "as available". We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that information on the Site is complete, accurate or current. Guidance published on the Site, including articles about tinting law, curing times, paint correction and product comparisons, is general information only and is not a substitute for professional advice about your particular vehicle.
To the fullest extent permitted by law, Auto Xpert and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, use or goodwill, arising out of or in connection with your use of the Site, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars ($100). Liability arising from services performed on your vehicle is governed by the agreement for those services and by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.
You agree to indemnify and hold harmless Auto Xpert and its owners, employees and agents from any claim, demand, loss, liability or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Site.
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Mateo County, California, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Auto Xpert regarding the Site.
We may revise these Terms at any time by updating this page. The "Last updated" date indicates when the current version took effect. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
